1. Introduction

Welcome to loadBySea.it. These Terms and Conditions govern access to and use of the Platform, which offers container tracking services and management of loading and unloading operations.

By using loadBySea.it, the User fully accepts these Terms and Conditions. If you do not agree with them, please do not use the Service.

2. Definitions

  • User: any natural or legal person who accesses and uses the Platform
  • Subscription: the paid contract that allows access to the Platform’s services
  • Container: a standardized cargo unit that can be tracked through the Platform
  • Account: the User’s personal reserved area on the Platform

3. Services Offered

loadBySea.it offers the following services to subscribed Users:

  • Real-time tracking of container location
  • Management of loading and unloading operations
  • Movement history
  • Customized notifications and alerts
  • Reporting and analytics on operations
  • Dedicated technical support

4. Registration and Account

4.1 Account Creation

To use the services, it is necessary to create an Account by providing accurate, complete and up-to-date information. The User is responsible for the truthfulness of the data provided.

4.2 Access Credentials

The User is responsible for safeguarding their access credentials and undertakes not to disclose them to third parties. Any activity carried out through the Account shall be considered as carried out by the registered User.

4.3 Requirements

To register, it is necessary to:

  • Be at least 18 years old
  • Have the legal capacity to enter into binding contracts
  • Provide a valid email address

5. Subscriptions and Payments

5.1 Types of Subscription

loadBySea.it offers the following types of subscription:

  • Monthly Subscription: automatic renewal every 30 days
  • Annual Subscription: automatic renewal every 12 months

5.2 Fees

The fees are clearly indicated on the website at the time of subscription. loadBySea.it reserves the right to change prices with at least 30 days’ notice.

5.3 Payment Methods

Payments may be made via:

  • PayPal

5.4 Automatic Renewal

Subscriptions renew automatically upon expiry, unless cancelled by the User at least 48 hours before the end of the billing period.

5.5 Invoicing

Invoices are issued electronically and sent to the registered email address within 5 working days of payment.

6. Cancellation and Refunds

6.1 Cancellation

The User may cancel the subscription at any time from the personal area. The cancellation shall take effect at the end of the current billing period.

6.2 Trial Period

Where provided, the User may benefit from a free trial period. In this case, cancellation before the expiry of the trial period shall not result in any charge.

6.3 Refunds

Payments already made are non-refundable, except as provided for by applicable legislation on the right of withdrawal for consumers.

6.4 Right of Withdrawal (Consumers)

Consumer Users have the right to withdraw from the contract within 14 days of subscription, without having to provide any reason, by sending written notice to loadBySea.it.

7. Use of the Service

7.1 Permitted Use

The User undertakes to use the Platform exclusively for lawful purposes and in compliance with these Terms and Conditions.

7.2 Prohibited Conduct

It is expressly prohibited to:

  • Violate laws, regulations or third-party rights
  • Transmit unlawful, defamatory or harmful content
  • Attempt to access systems or data without authorization
  • Interfere with the proper functioning of the Platform
  • Use bots, scrapers or other automated tools without authorization
  • Resell or transfer access to the Service to third parties

8. Intellectual Property

All content on the Platform, including texts, graphics, logos, icons, images, software and code, is the property of loadBySea.it or the respective owners and is protected by copyright and intellectual property laws.

The User is granted a limited, non-exclusive and non-transferable licence to use the Platform solely for the purposes set out in these Terms.

9. Privacy and Data Protection

The processing of Users’ personal data is carried out in compliance with applicable personal data protection legislation (GDPR - EU Regulation 2016/679) and as described in our Privacy Policy.

By using the Platform, the User consents to the processing of their data according to the methods described in the Privacy Policy.

10. Service Availability

10.1 Service Guarantee

loadBySea.it undertakes to keep the Platform operational 24 hours a day, 7 days a week, with an annual uptime of 99%.

10.2 Maintenance

The Platform may be temporarily unavailable for scheduled maintenance operations, of which Users will be notified in advance.

10.3 Limitation of Liability

loadBySea.it does not guarantee that the Service will be free from errors or interruptions and shall not be liable for any disruptions caused by circumstances beyond its control.

11. Limitation of Liability

loadBySea.it provides the Platform “as is” and makes no implied or express warranties regarding the accuracy, completeness or reliability of the information provided.

Under no circumstances shall loadBySea.it be liable for:

  • Indirect, incidental or consequential damages
  • Loss of profits or business opportunities
  • Loss of data or information
  • Decisions made based on the information provided by the Platform

The maximum liability of loadBySea.it shall in any case be limited to the amount paid by the User in the last 12 months.

12. Indemnity

The User undertakes to indemnify and hold loadBySea.it harmless from any claim, damage, loss, liability and expense, including legal fees, arising from:

  • Violation of these Terms and Conditions
  • Violation of applicable laws or regulations
  • Violation of third-party rights

13. Changes to the Terms and Conditions

loadBySea.it reserves the right to amend these Terms and Conditions at any time. Changes will be published on the Platform and communicated by email to registered Users.

Continued use of the Platform after publication of the changes constitutes acceptance of them.

14. Suspension and Termination

14.1 Account Suspension

loadBySea.it reserves the right to suspend or deactivate the User’s Account in the event of:

  • Violation of these Terms and Conditions
  • Failure to pay subscription fees
  • Fraudulent or illegal activities
  • Conduct that may damage the Platform or other Users

14.2 Termination

Either party may terminate the contract by written notice. In the event of termination, the User shall immediately lose access to the data stored on the Platform.

15. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Italian law.

For any dispute relating to the interpretation, performance or termination of these Terms, exclusive jurisdiction shall lie with the Court of the place of residence or domicile of the consumer, where applicable, or with the Court of [City of loadBySea.it’s registered office].

16. Alternative Dispute Resolution

In accordance with EU Regulation No. 524/2013, Users are informed that they may use the European online dispute resolution platform (ODR), available at the following link: https://ec.europa.eu/consumers/odr

17. Final Provisions

17.1 Severability

If one or more provisions of these Terms and Conditions are declared null or ineffective, the remaining provisions shall remain valid and effective.

17.2 Assignment

The User may not assign the rights and obligations arising from these Terms without the prior written consent of loadBySea.it.

17.3 Entire Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between the parties.
